TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to a lack of a selection decision and, thus, due to the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically and independently thereof upon entry into force of the exclusive contract for the active substance Guselkumab (exclusively 100 mg strength), ATC L04AC16, as a result of a formal procurement procedure in accordance with the provisions of Part 4 of the GWB with one or more contractual partners. To ensure consideration of the diversity of potential contractual partners within the framework of the approval model, each pharmaceutical company will be allowed at any time during the term of the contract to conclude a framework agreement under the same conditions.
