TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access option for all pharmaceutical companies. It ends automatically, regardless of anything else, upon the entry into force of the exclusive agreement for the active substance Indacaterol + Glycopyrronium bromide, ATC R03AL04, as a result of a formal procurement procedure in accordance with the provisions of Part 4 of the GWB with one or more contract partners. In order to accommodate the diversity of potential contract partners within the admission model, during the term of the contract the conclusion of a framework agreement will be made possible for every pharmaceutical company at any time and on the same terms.
