DAK-Gesundheit assumes that, due to the absence of a selection decision and thus the non-discriminatory access option for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends automatically regardless of anything else upon the entry into force of the exclusive agreement for the active ingredient Indacaterol + Glycopyrronium bromide, ATC R03AL04, as a result of a formal contract-awarding procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. In order to accommodate the diversity of potential contracting parties within the scope of the approval model, the conclusion of a framework agreement with any pharmaceutical company is permitted at any time during the term of the contract and under the same conditions.
