TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to a lack of selection decision and thus the non-discriminatory possibility of access for all pharmaceutical companies, this procedure does not fall within the scope of cartel tendering law. It ends, independently of this, automatically upon entry into force of the exclusive contract for the active ingredient interferon beta-1a (exclusively for subcutaneous use), ATC L03AB07, as a result of a formal tender procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the framework of the approval model, every pharmaceutical company is allowed, at any time during the term of the contract, to conclude a framework agreement at any time and under the same conditions.
