TENDER DESCRIPTION

The DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel award law due to the lack of a selection decision and thus the non-discriminatory access option for all pharmaceutical companies. It ends automatically and regardless of anything else upon entry into force of the exclusive contract for the active ingredient interferon beta-1a (exclusively for subcutaneous use), ATC L03AB07, as a result of a formal award procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the framework of the approval model, each pharmaceutical company is allowed, at any time during the term of the contract, to conclude a framework agreement for every time and under the same conditions.
