DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the lack of a selection decision and hence the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically, regardless, upon entry into force of the exclusivity contract for the active ingredient latanoprost (exclusively EDO 30x0.3 ml and 90x0.3 ml), ATC S01EE01, as a result of a formal procurement procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the approval model, each pharmaceutical company will be allowed, at any time during the contract term, to conclude a framework agreement on the same terms.
