DAK-Gesundheit assumes that, due to the absence of a selection decision and, accordingly, the non-discriminatory access possibility for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. Irrespective of this, it ends automatically upon entry into force of the exclusive contract for the active ingredient Latanoprost (exclusively EDO 30x0.3 ml and 90x0.3 ml), ATC S01EE01, as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the framework of the admission model, each pharmaceutical company is enabled, at any time during the term of the contract, to conclude a framework contract under the same conditions.
