DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies. It ends automatically regardless with the entry into force of the exclusivity contract for the active ingredient Lidocaine, ATC N01BB02, following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the variety of potential contracting partners within the framework of the approval model, each pharmaceutical company is enabled to conclude a framework agreement at any time and under the same conditions during the term of the contract. The necessary contract documents can be downloaded via the online portal www.dtvp.de/center at the link specified under 5.1.11.
