DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically regardless upon the entry into force of the exclusive contract for the active ingredient Lidocaine, ATC N01BB02, following a formal procurement procedure under the regulations of Part 4 of the GWB with one or more contracting parties. To do justice to the diversity of potential contracting parties within the approval model, every pharmaceutical company is allowed to conclude a framework agreement at any time and under the same conditions during the term of the contract. The necessary contract documents are available for download via the online portal www.dtvp.de/center at the link specified under 5.1.11.
