DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies. It automatically ends regardless with the entry into force of the exclusive contract for the active ingredient Natalizumab (exclusively dosage form ILO), ATC L04AA23, following a formal procurement procedure under the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the variety of potential contracting partners within the framework of the approval model, each pharmaceutical company is enabled to conclude a framework contract at any time and under the same conditions during the contract term.
