DAK-Gesundheit assumes that, due to a lack of a selection decision and hence the non-discriminatory access opportunity for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. Regardless, it automatically ends with the entry into force of the exclusive contract for the active ingredient Natalizumab (exclusively infusion solution concentrate), ATC L04AG03, as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the framework of the approval model, each pharmaceutical company is offered, at any time during the term of the contract, the conclusion of a framework agreement under the same conditions.
