TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically regardless upon entry into force of the exclusive contract for the active ingredient Oxybutynin (exclusively dosage form PFT), ATC G04BD04, following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the diversity of potential contracting partners within the approval model, every pharmaceutical company is enabled at any time during the contract term to conclude a framework agreement under the same conditions.
