DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and therefore the non-discriminatory access possibility for all pharmaceutical companies, does not fall within the scope of cartel procurement law. In any case, it ends automatically with the entry into force of the exclusive contract for the active ingredient Perampanel, ATC N03AX22, following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To meet the diversity of potential contracting partners within the framework of the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time during the contract term and under the same conditions.
