TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of the cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies. It ends automatically regardless upon the entry into force of the exclusive contract for the active ingredient Perampanel, ATC N03AX22, following a formal tender procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the variety of potential contracting partners within the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time during the contract period and under the same conditions. The contractual documents required for this purpose are available for download via the online portal www.dtvp.de/center under the link mentioned in section 5.1.11.
