DAK-Gesundheit assumes that this procedure, due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, does not fall within the scope of cartel procurement law. It ends automatically regardless with the entry into force of the exclusive contract regarding the active substance Piracetam, ATC N06BX03, following a formal award procedure under the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the variety of potential contracting partners within the scope of the approval model, each pharmaceutical company is enabled at any time during the contract term to conclude a framework contract under the same conditions. The necessary contractual documents are available for download via the online portal www.dtvp.de/center at the link specified under section 5.1.11.
