DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies. It will automatically end regardless upon entry into force of the exclusive contract for the active ingredient Piracetam, ATC N06BX03, following a formal procurement procedure under the regulations of Part 4 of the GWB with one or more contractual partners. To accommodate the diversity of potential contractual partners within the approval model, every pharmaceutical company is enabled at any time during the contract period to conclude a framework agreement under the same conditions. The required contractual documents are available for download via the online portal www.dtvp.de/center at the link indicated under section 5.1.11.
