DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It terminates automatically regardless upon the entry into force of the exclusive contract for the active ingredient Ranibizumab, ATC S01LA04, following a formal procurement procedure according to the regulations of the 4th part of the GWB with one or more contracting partners. To do justice to the diversity of potential contracting partners within the framework of the approval model, every pharmaceutical company is enabled at any time during the contract term to conclude a framework agreement under the same conditions.
