DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It will end automatically regardless with the entry into force of the exclusivity contract for the active ingredient Rifaximin, ATC A07AA11, as a result of a formal award procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To accommodate the variety of potential contracting partners within the framework of the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time during the contract period and under the same conditions.
