DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It will end automatically regardless upon the entry into force of the exclusive contract for the active ingredient Rifaximin, ATC A07AA11, following a formal tender procedure under the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the variety of potential contracting partners within the scope of the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time during the contract term and under the same conditions. The contractual documents required for this are available for download via the online portal www.dtvp.de/center under the link mentioned in 5.1.11.
