TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the absence of a selection decision and thus due to the non-discriminatory access opportunity for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends, regardless of this, automatically upon the entry into force of the exclusive contract for the active ingredient risedronate (exclusively FTA 5mg and 75mg), ATC M05BA07, as a result of a formal procurement procedure in accordance with the provisions of Part 4 of the GWB with one or more contract partners. In order to accommodate the diversity of potential contract partners within the authorisation model, each pharmaceutical company is enabled, during the term of the contract, to enter into a framework agreement at any time under the same conditions.
