TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the absence of a selection decision and, consequently, a non-discriminatory access possibility for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends automatically, regardless of this, upon the entry into force of the exclusive contract for the active ingredient Risedronic acid (excluding FTA 5mg and 75mg), ATC M05BA07, as a result of a formal award procedure in accordance with the regulations of Part 4 of the GWB with one or more contract partners. In order to do justice to the diversity of potential contract partners within the admission model, every pharmaceutical company is enabled, at any time during the term of the contract, to accede to a framework agreement on the same terms and conditions.
