TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the absence of a selection decision and thus due to the non-discriminatory access possibility for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends automatically regardless of this with the entry into force of the exclusive contract for the active substance Sulfasalazine (exclusively FMR in the standard pack size N2), ATC M01CX02, as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contract partners. To ensure that the diversity of potential contract partners under the approval model is taken into account, during the term of the contract every pharmaceutical company is granted the opportunity to conclude a framework agreement at any time under the same conditions.
