DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the nondiscriminatory access possibility for all pharmaceutical companies. It ends independently and automatically upon the entry into force of the exclusivity contract for the active ingredient Tacrolimus, ATC L04AD02 following a formal award procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the variety of potential contracting partners within the framework of the approval model, every pharmaceutical company is allowed to conclude a framework agreement at any time during the contract period and under the same conditions. The required contractual documents are available for download via the online portal www.dtvp.de/center at the link specified under 5.1.11.
