DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the lack of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies. It ends automatically regardless upon the entry into force of the exclusive contract for the active ingredient Tacrolimus, ATC L04AD02 following a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting partners. To do justice to the diversity of potential contracting partners within the framework of the approval model, each pharmaceutical company is enabled at any time during the contract term to conclude a framework agreement on the same conditions.
