TENDER DESCRIPTION

DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access option for all pharmaceutical companies. It ends automatically regardless of this upon the entry into force of the exclusive contract for the active ingredient Thalidomide, ATC L04AX02, as a result of a formal tender procedure in accordance with the rules of Part 4 of the GWB with one or more contract partners. To ensure fairness to the diversity of potential contract partners within the framework of the approval model, each pharmaceutical company is allowed, at any time during the term of the contract, to enter into a framework agreement under the same conditions.
