DAK-Gesundheit assumes that this procedure does not fall within the scope of cartel procurement law due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies. It ends automatically and independently upon the entry into force of the exclusive contract for the active ingredient Triptorelin, ATC L02AE04, as a result of a formal procurement procedure according to the regulations of Part 4 of the GWB with one or more contracting parties. To do justice to the diversity of potential contracting parties within the approval model, each pharmaceutical company is enabled to conclude a framework contract at any time during the contract period and under the same conditions.
