TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the absence of a selection decision and thus because of the non-discriminatory access option for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. Regardless of this, it ends automatically upon entry into force of the exclusive contract for the active substance Ublituximab, ATC L04AG14, as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. To take account of the variety of potential contracting parties within the approval model, each pharmaceutical company is allowed to join the framework agreement at any time during the term of the contract and on the same terms and conditions.
