TENDER DESCRIPTION

DAK-Gesundheit assumes that, due to the lack of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. Regardless of this, it ends automatically upon entry into force of the exclusive contract for the active substance Ublituximab, ATC L04AG14, as a result of a formal procurement procedure in accordance with the provisions of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the approval model, each pharmaceutical company is allowed, at any time during the term of the contract, to conclude a framework agreement at any time under the same conditions.
