DAK-Gesundheit assumes that this procedure does not fall within the scope of competition procurement law due to the absence of a selection decision and thus the non-discriminatory access possibility to all pharmaceutical companies. It automatically terminates regardless with the entry into force of the exclusive contract for the active ingredient Umeclidinium + Vilanterol, ATC R03AL03, following a formal procurement process according to the regulations of Part 4 of the GWB with one or more contracting partners. To account for the diversity of potential contracting partners within the approval model, every pharmaceutical company is enabled to conclude a framework agreement at any time and on the same conditions during the contract period. The necessary contract documents are available for download via the online portal www.dtvp.de/center under the link named under 5.1.11.
