TENDER DESCRIPTION

The ARGE-OH-BioTech Filgrastim assumes that, due to the absence of an selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. Irrespective of this, it ends automatically upon the entry into force of the exclusive agreement for Filfgrastim, ATC L03AA02 as a result of a formal procurement procedure in accordance with the regulations of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the scope of the approval model, during the term of the contract the conclusion of a framework agreement is made possible for every pharmaceutical company at any time and on the same terms and conditions.
