TENDER DESCRIPTION

The ARGE-OH-BioTech Filgrastim assumes that, due to the lack of a selection decision and thus the non-discriminatory access possibility for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends automatically and independently upon the entry into force of the exclusive contract for Filgrastim, ATC L03AA02 as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. To ensure fairness with respect to the diversity of potential contracting parties within the framework of the approval model, each pharmaceutical company is enabled, at any time during the term of the contract, to enter into a framework agreement for the same conditions.
