TENDER DESCRIPTION

ARGE-OH-BioTech Pegfilgrastim assumes that, due to the absence of a selection decision and thus the non-discriminatory access opportunity for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends automatically, regardless of this, upon entry into force of the exclusive contract for Pegfilgrastim, ATC L03AA13 as a result of a formal award procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the approval model, every pharmaceutical company will be given the possibility, at any time during the term of the contract, to conclude a framework contract with each pharmaceutical company at any time and on the same terms.
