TENDER DESCRIPTION

The ARGE-OH-BioTech Pegfilgrastim assumes that, due to the absence of a selection decision and thus the non-discriminatory possibility of access for all pharmaceutical companies, this procedure does not fall within the scope of cartel procurement law. It ends automatically regardless of the above upon the entry into force of the exclusive contract for Pegfilgrastim, ATC L03AA13 as a result of a formal procurement procedure in accordance with the rules of Part 4 of the GWB with one or more contracting parties. In order to do justice to the diversity of potential contracting parties within the approval model, the conclusion of a framework contract at any time and on the same terms is made possible for every pharmaceutical company throughout the term of the contract.
