TENDER DESCRIPTION
The maintenance requirement according to the technical performance specification (Chapter B) comprises a stock of 95 mobile 450 l fuel tanks and one mobile 1000 l fuel container. With regard to the framework agreement, no minimum quantities for acceptance are agreed. According to the case law of the CJEU of 17.06.2021_RS C - 23/20, the contracting authority is required to ensure transparency and non-discrimination in competition by specifying a maximum quantity. No call-off obligation can be derived from this. The contracting authority estimates that, over the entire term of the contract, there will be a requirement for maintenance amounting to approximately EUR 390,000. The maximum quantity of the attached framework agreement is quantified at EUR 540,000.
