TENDER DESCRIPTION

With regard to the framework agreement, no minimum call-off quantities are agreed. According to the case-law of the CJEU of 17.06.2021 _ Case C - 23/20 -, the contracting authority is required to specify a maximum quantity in order to ensure transparency and non-discrimination in competition. No call-off obligation can be derived from this. The contracting authority estimates that the following demand exists for the individual lots over the entire term of the contract: Lot 1: - 12,000 units of handcuffs, lockable The maximum quantity of the attached framework agreement is stated as 14,000 units of handcuffs, lockable. Lot 2: - 12,000 units of handcuff carrying pouch for handcuffs, lockable The maximum quantity of the attached framework agreement is stated as 14,000 units of handcuff carrying pouch for handcuffs, lockable. The framework agreements end without requiring termination, depending on which event occurs earlier, upon the expiry of the term of the respective framework agreement (minimum term when the contracting authority exercises its right to terminate, or maximum term in the event that the contracting authority does not terminate) or upon reaching the maximum quantity.
