TENDER DESCRIPTION

This notice serves to conclude medicine rebate agreements pursuant to Section 130a(8) or Section 130c(1), SGB V, for the active ingredient(s) specified under the title. This is not the award of public contracts within the meaning of Directive 2014/24/EU or Sections 97 et seq. of the GWB. Any pharmaceutical entrepreneur may become a contractual partner pursuant to Section 4(18) of the AMG. Pursuant to the case-law of the CJEU, such approval procedures are not necessarily subject to procurement law, as no competition takes place due to the lack of a selection decision. The notice serves as an invitation to conclude rebate agreements with conditions that apply equally to all contractual partners and are non-dispositive, including the setting of the rebate. The contract is concluded by signing the contract documents and submitting the required declarations, which can be requested from the named contact office.
