TENDER DESCRIPTION

The present notice serves for the conclusion of pharmaceutical rebate contracts pursuant to § 130a(8) or § 130c(1) SGB V for the active ingredient(s) stated under the title. This is not the award of public contracts within the meaning of Directive 2014/24/EU or of §§ 97 et seq. GWB. Any pharmaceutical entrepreneur may become a contractual partner pursuant to § 4(18) AMG. According to the case-law of the CJEU, such approval procedures are not necessarily subject to procurement law, since, due to the absence of a selection decision, no competition takes place. The notice serves as an invitation to conclude rebate contracts with conditions that are applicable to all contractual partners and that are non-discretionary, including the determination of the rebate. The contract is concluded by signing the contract documents and submitting the required declarations, which may be requested from the named contact office.
