TENDER DESCRIPTION

This notice serves for the conclusion of pharmaceutical rebate agreements pursuant to Section 130a(8) or 130c(1) of Book V of the Social Code (SGB V) covering the active ingredient(s) stated under the title. This is not the award of public contracts within the meaning of Directive 2014/24/EU or Sections 97 et seq. of the GWB. Any pharmaceutical entrepreneur within the meaning of Section 4(18) of the AMG may become a contracting party. According to the CJEU case-law, such approval procedures are not necessarily subject to procurement law, because due to the lack of an award selection decision no competition takes place. The notice serves as an invitation to conclude rebate agreements with conditions that apply equally to all contracting parties and are non-dispositive, including the determination of the rebate. The contract is concluded by signing the contract documents and submitting the declarations required, which may be requested from the specified contact point.
