TENDER DESCRIPTION
This notice is intended for the conclusion of pharmaceutical medicinal product rebate agreements pursuant to Section 130a(8) or Section 130c(1) SGB V for the active ingredient(s) listed under the title. This does not involve the award of public contracts within the meaning of Directive 2014/24/EU or Sections 97 et seq. GWB. Any pharmaceutical entrepreneur may become a contracting party pursuant to Section 4(18) AMG. In accordance with the case-law of the CJEU, such approval procedures are not necessarily subject to procurement law, since, due to the absence of an award decision, no competition takes place. The notice serves as an invitation to conclude rebate agreements with conditions that apply equally to all contracting parties and that are non-negotiable, including the fixing of the rebate. The contract is concluded by signing the contract documents and submitting the statements required, which can be requested from the named contact point.
