TENDER DESCRIPTION

This notice serves to conclude pharmaceutical rebate contracts pursuant to § 130a(8) or § 130c(1) SGB V for the active ingredient(s) stated under the title. This is not the award of public contracts within the meaning of Directive 2014/24/EU or of §§ 97 et seq. GWB. Any pharmaceutical entrepreneur may become a contracting party pursuant to § 4(18) AMG. According to the case-law of the CJEU, such approval procedures are not necessarily subject to procurement law, since, due to the lack of a selection decision, no competition takes place. The notice is intended as an invitation to conclude rebate contracts with conditions that apply equally to all contracting parties and are non-dispositive, including the setting of the rebate. The contract is concluded by signing the contract documents and submitting the required declarations, which may be requested from the specified contact point.
