TENDER DESCRIPTION

This notice serves for the conclusion of pharmaceutical discount contracts pursuant to § 130a paragraph 8 or § 130c paragraph 1 SGB V for the active substance(s) listed under the title. This is not the award of public contracts within the meaning of Directive 2014/24/EU or §§ 97 et seq. GWB. The contracting party may be any pharmaceutical entrepreneur pursuant to § 4 paragraph 18 AMG. According to the case-law of the CJEU, such approval procedures are not necessarily subject to procurement law, as due to the lack of an award decision no competition takes place. The notice is intended as an invitation to conclude discount contracts with terms and conditions that apply equally to all contracting parties and are non-negotiable, including the determination of the discount.
