TENDER DESCRIPTION

This notice serves to conclude pharmaceutical rebate agreements pursuant to Section 130a(8) or Section 130c(1) SGB V regarding the active ingredient(s) stated under the title. This is not the award of public contracts within the meaning of Directive 2014/24/EU or Sections 97 et seq. of the GWB. The contracting party may be any pharmaceutical entrepreneur pursuant to Section 4(18) of the AMG. According to the case-law of the CJEU, such approval procedures are not necessarily subject to procurement law, since, owing to the absence of a selection decision, no competition takes place. The notice serves as an invitation to conclude rebate agreements with terms that are applicable to all contracting parties and that are non-dispositive, including the fixing of the rebate. The agreement is concluded by signing the contract documents and submitting the required declarations, which can be requested from the named contact point.
