The service being tendered is set out in the tender documents. ------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------ The contracting authority bears the risk of unforeseen changes in legislation and requirements from authorities which could not reasonably have been foreseen at the time the tender was submitted. The contract therefore includes a regulatory mechanism for documented net costs and provisions regarding the parties’ rights if the changes significantly affect the basis of the contract. The contracting authority’s risk also includes the consequences of the new nitrogen regulation and unforeseen changes in legislation or requirements from authorities which result in the supplier’s ability to dispose of sludge for the intended use, in whole or in part, ceasing or being significantly limited.
