3.3. The Contracting Authority’s requirements concerning the subject matter of the contract: 1) the offered product must have approvals, certificates and must be registered in accordance with the provisions of law requiring the possession of approvals, certificates and registration, 2) the offered product must comply with the standards or technical specifications applicable to this product; 3.4. In cases where trade marks, patents or origin, source or a special process that characterises specific products or services supplied by a particular Contractor have been indicated in the description of the subject matter of the contract, this means that the Contracting Authority cannot describe the subject matter of the contract in a sufficiently precise and understandable manner; however, in each such case the Contracting Authority allows a solution equivalent to those described above. In such situations, any indications of trade marks, patents, origin, source or a special process that characterises specific products or services supplied by a particular Contractor should be read together with the words “or equivalent”.
