Award of a concession for the “procurement of prisoners in the Erlangen correctional facility” (service concession). The subject matter of the contract is classified as a service concession. The economic risk is borne by the concessionaire. Service concessions are not directly subject, in the sub-threshold area, to procurement law provisions. In order to ensure the required transparency and the competitive nature as well as a possible relevance for the internal market, the procedure is nevertheless published in full by means of a contract notice and is carried out in line with the provisions applicable to the award of contracts in the context of a Public Tender, without these provisions finding legal application.
