The contract timeline is as follows:

The service period and the term of the framework agreement begin on the date of the award.

The total duration of the contract is one year, with a maximum of three options to extend for an additional year each (1+1+1+1), leading to a maximum total duration of four years for the framework agreement.

Individual call-offs for software licenses and add-ons, including associated maintenance and support services, are made under the framework agreement. Deliveries for these individual call-offs are to be completed within 7 working days of receiving the individual order, unless a different delivery time is specified in the individual contract. Orders placed before the framework agreement expires remain valid until all services are fully rendered.

The core scope of work for this tender involves the temporary provision of non-personal Premium and Ultimate licenses for the GitLab software platform, along with related Paid Add-Ons, for a period of one year with an option for up to three extensions.

Specifically, the tender includes the following key deliverables and services:

• Jahreslizenzen (Annual Licenses): Provision of GitLab Premium and GitLab Ultimate annual licenses.
• Paid Add-Ons: Provision of specific GitLab Paid Add-Ons, including GitLab Duo Pro, GitLab Duo Enterprise, and GitLab Enterprise Agile Planning. These add-ons are intended to extend and supplement the functionality of the GitLab licenses and are not standalone products.
• On-Premises Provision: The software licenses must be provided to the client as an on-premises variant, in accordance with the German Federal Office for Information Security (BSI) requirements.
• License Provision: The contractor is responsible for electronically providing the licenses (e.g., as a download) and all necessary information for software download (e.g., download link, login-name, password) in a timely manner before the first individual order. They must ensure access to the download and subsequent contractual use of the software.
• Maintenance and Support: The contractor is obligated to provide new program versions, including patches (security patches and bug fixes), updates, upgrades, and releases/versions for the standard software. This also includes the implementation of legal and other norm changes.
• Documentation: The contractor must document the standard software. The documentation can be duplicated a specified number of times. In cases of maintenance services, the contractor must document the services performed in an appropriate manner, usually in German and an electronic format, and make it accessible to the client. This includes an overview of all program versions provided and installed, as well as accompanying documents like license certificates and keys.
• Timely Delivery: Deliveries must be complete and functional within 7 working days after receipt of the individual order, unless a different delivery time is specified in the individual call-off contract. The contractor must promptly notify the client if delivery deadlines cannot be met.
• Current License Portal: The contractor must ensure that the license provider portal is kept current and properly maintained.
• Single Point of Contact (SPOC): The contractor must designate a contact person available Monday to Friday between 09:00 and 16:00, excluding federal holidays, who is proficient in German (B2 level minimum).
• Partner Status: The contractor must possess at least the "GitLab Open Partner" status.
• Risk of Provision: The contractor bears the risk of successful provision up to the technical handover point on the IT system of the respective client.
