La naturalesa jurídica del contracte és la de contracte de concessió de serveis, de conformitat amb els articles 15 i 284 i següents de la LCSP, atès que el seu objecte consisteix en la gestió i explotació d’un servei públic municipal de restauració la titularitat del qual correspon a l’Ajuntament i en el qual la retribució del concessionari deriva principalment del dret d’explotació del servei, assumint aquest el risc operacional en els termes previstos a la LCSP. En tractar-se d’un servei públic, consta prèviament establert el seu règim jurídic, d’acord amb l’article 284.2 LCSP.

The legal nature of the contract is that of a service concession contract, in accordance with Articles 15 and 284 and the following of the LCSP, since its purpose consists of the management and operation of a municipal public catering service whose ownership corresponds to the City Council, in which the concessionaire’s remuneration derives mainly from the right to operate the service, with the concessionaire assuming the operational risk in the terms provided for in the LCSP.
