TENDER DESCRIPTION
The legal nature of the contract is that of a services concession contract, in accordance with articles 15 and 284 and following of the LCSP, given that its purpose consists of the management and operation of a municipal public catering service the ownership of which corresponds to the City Council (Ajuntament), and in which the concessionaire’s remuneration derives mainly from the right to operate the service, with the latter assuming the operational risk under the terms provided for in the LCSP. As it is a public service, its legal regime has been established in advance, in accordance with article 284.2 of the LCSP.
