Gegenstand dieses Vertrages ist die umfassende Versorgung des Auftraggebers mit Berufsbekleidung für den Gemeindebauhof durch den Auftragnehmer.

TENDER DESCRIPTION

The contract includes in particular: a) the rental provision of workwear for use by the contracting authority's employees, see Annex 3 (Specification of services), Annex 1 (Bill of quantities) b) the regular cleaning, maintenance, and disinfection of the provided workwear, c) the repair of damaged or worn workwear, d) the replacement of worn out or unusable workwear, e) the provision of a digital communication and inventory management platform (software), including its operation and maintenance f) logistics services for the collection, delivery, and exchange traffic including provision of lockers. This contract constitutes a mixed contract that combines elements of rental law pursuant to §§ 535 et seq. of the German Civil Code (provision of workwear for use against remuneration, provision and operation of the software) as well as elements of contract works law pursuant to §§ 631 et seq. of the German Civil Code (e.g. cleaning, maintenance, and repair as contractual works services).
