The subject of this public procurement is: “Rehabilitation of part of road PDV 3235 III-565, Shishmantsi-Orizovo /- Belozem-Bolyarino-Boundary (municipality boundary) (Rakovski-Brezovo)-Choba- /III-666/, municipality of Rakovski“, Subject: from km 0+000 to km 3+965 (north of village Bolyarino)“ The construction works are Category III under the Spatial Planning Act (ZUT). A design has been prepared for the site and a valid construction permit has been issued. Source of funding: When launching this procurement procedure for awarding a public procurement contract, no funding has been secured; therefore, the contract draft provides for a clause on deferred performance, on the basis of Article 114 of the Public Procurement Act (ЗОП). In this case, each of the parties may request termination of the contract without prior notice after the expiry of a three-month period from its conclusion. It should be made clear that, pursuant to Article 114(2) of the Public Procurement Act (ЗОП), performance under the contract begins after confirmation by the contracting authority that the funding has been secured and after the contractor submits the specified performance security.
